Welcome to PocketAppraisal, a product of BAINJ PTY LTD, designed to assist real estate agents in Australia and New Zealand with online auto appraisals. By using our software, you agree to the following Terms and Conditions. Please read them carefully.

1. Business Entity Information

2. Compliance with Australian Consumer Law

We are committed to complying with the Australian Consumer Law (ACL). These terms are intended to reflect the rights and obligations outlined under ACL, and nothing in these Terms and Conditions seeks to exclude, restrict, or modify your statutory rights under Australian law.

3. Data Collection and Privacy

We collect personal information, including your full name, email address, phone number, and in some cases, your ABN or real estate license number. This data is stored securely within our Customer Relationship Manager (CRM) system. By providing this information, you consent to the collection, storage, and use of your data in accordance with our Privacy Policy.

We may occasionally use your contact details and appraisal results for marketing purposes, such as sending you updates, offers, or newsletters. You may opt out of receiving marketing communications at any time by contacting us at jordan@jordanbain.com.au.

4. Refund Policy

PocketAppraisal provides no refunds for services unless the software has been inactive for an extended period as determined by our sole discretion. In the case of software inactivity, you may be entitled to a refund or credit.

5. Subscription and Cancellation Policy

To cancel your subscription, you must provide 30 days' written notice via email to jordan@jordanbain.com.au. Cancellations will take effect at the end of the 30-day notice period, during which you may continue to use the software. No pro-rata refunds or credits will be issued for the cancellation notice period.

6. Limitations of Liability

BAINJ PTY LTD is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the PocketAppraisal software. While we strive to provide uninterrupted service, we make no guarantees as to availability or functionality.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Australia.

8. Modifications to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the software signifies your acceptance of the updated terms.
